Terms of Service

By downloading, installing, accessing, or using Mercy ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the App. These Terms constitute a legally binding agreement between you and Daniel Sogl ("we," "us," or "our") regarding your use of the App. We reserve the right to modify these Terms at any time. Continued use of the App after any modifications constitutes acceptance of the updated Terms.

Mercy is a statistics tracker app for Overwatch 2 that allows you to: - View player statistics and rankings - Search for and follow player profiles - Browse hero and map information - Track your own game statistics (using your BattleTag) The App uses the OverFast API to provide Overwatch 2 game data. This data is retrieved from Blizzard Entertainment servers and may be subject to caching delays.

App Ownership: The App, including its design, features, and code, is owned by Daniel Sogl and protected by intellectual property laws. Third-Party Trademarks: Overwatch® is a registered trademark of Blizzard Entertainment, Inc. This App is: - NOT affiliated with Blizzard Entertainment - NOT endorsed or sponsored by Blizzard Entertainment - NOT developed or maintained by Blizzard Entertainment All Overwatch-related content displayed in the App, including hero images, maps, and game statistics, are the property of Blizzard Entertainment, Inc. Data Sources: Player statistics and game data are provided through the OverFast API (https://overfast-api.tekrop.fr/), which retrieves publicly available data from Blizzard Entertainment. License to Use: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes. Restrictions: You may not: - Copy, modify, or distribute the App - Reverse engineer or decompile the App - Remove copyright or proprietary notices - Use the App for commercial purposes without permission - Create derivative works based on the App

OverFast API: The App uses the OverFast API to provide Overwatch 2 game data. Please note: - Data may not be real-time due to API caching - Player profiles must be public to be searchable - API availability is outside our control - Rate limits apply (30 requests per second per IP) We do not guarantee the accuracy, completeness, or timeliness of data provided through the OverFast API. Blizzard Entertainment Data: All Overwatch 2 game data ultimately originates from Blizzard Entertainment. Use of this data is subject to Blizzard Entertainment's terms of service.

Display of Advertisements: The App displays advertisements to support free access. Advertisement Placement: - Banner advertisements on certain screens - Advertisements are served through Google AdMob Your Choices: - Control personalized advertising via iOS Settings > Privacy & Security > Tracking Third-Party Content: - Advertisements are provided by third parties - We do not control or endorse the content of advertisements - We are not responsible for products or services advertised - Clicking on advertisements is at your own risk Privacy: For information about how advertising data is collected and used, please see our Privacy Policy.

You agree not to: Security Violations: - Attempt to circumvent security measures or access controls - Interfere with the App's operation - Transmit viruses or malicious code Misuse of Services: - Use the App for illegal purposes - Violate any applicable laws or regulations - Use automated systems to access the App - Bypass rate limiting or usage restrictions Harmful Behavior: - Impersonate others or misrepresent your identity - Use the App to harass or stalk others - Attempt to access player profiles that are set to private

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including: - Merchantability - Fitness for a particular purpose - Non-infringement - Accuracy of content - Uninterrupted or error-free service Data Accuracy: We do not guarantee the accuracy, completeness, or timeliness of: - Player statistics and rankings - Hero information and ability data - Map details and game mode information - Any other game data provided by the OverFast API API Availability: The App depends on the OverFast API and Blizzard Entertainment servers. We cannot guarantee: - Continuous service availability - Real-time data updates - Continued support for all features No Affiliation with Blizzard: This App is NOT affiliated with, endorsed by, or sponsored by Blizzard Entertainment. All game content and trademarks are property of their respective owners.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including: - Loss of data - Business interruption - Personal injury or property damage - Any damages arising from use of the App Exceptions: These limitations do not apply to: - Liability that cannot be excluded by law - Gross negligence or intentional misconduct - Breach of essential contractual obligations German Law: Under German law (BGB), liability for damages to life, body, or health and for intentional or grossly negligent conduct cannot be limited.

You agree to indemnify, defend, and hold harmless Daniel Sogl from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: - Your use of the App - Your violation of these Terms - Your violation of any third-party rights - Your violation of applicable laws We reserve the right to assume exclusive defense of any matter subject to indemnification. You agree to cooperate with our defense.

Termination by You: You may stop using the App at any time by uninstalling it. Termination by Us: We may suspend or terminate your access if you: - Violate these Terms - Engage in fraudulent or illegal activity Effect of Termination: Upon termination: - Your license to use the App ends immediately - All locally stored data is deleted upon uninstallation - Provisions that should survive termination will remain in effect Survival: Sections relating to intellectual property, disclaimers, limitation of liability, indemnification, and governing law survive termination.

These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions. Jurisdiction: For disputes arising from these Terms: - If you are a consumer in the EU, you may bring claims in your local courts - For all other users, exclusive jurisdiction is in the courts of Germany EU Consumer Rights: If you are a consumer in the European Union, you retain any mandatory consumer protection rights under your local laws.

Informal Resolution: Before initiating formal proceedings, we encourage you to contact us to resolve disputes informally. Time Limit: Any claim must be brought within one year of the event giving rise to the claim, unless a longer period is required by applicable law.

If any provision of these Terms is found to be invalid, illegal, or unenforceable: - That provision shall be modified to the minimum extent necessary to make it valid - If modification is not possible, the provision shall be severed - The remaining provisions shall continue in full force and effect - The parties shall negotiate in good faith to replace invalid provisions The invalidity of one provision does not affect the validity of other provisions.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App. These Terms supersede all prior agreements, understandings, and communications regarding the App. No waiver of any provision shall be deemed a waiver of any other provision. Our failure to enforce any right does not constitute a waiver of that right.
